How much long service leave do I get in NSW?

Two months (8.67 weeks) of paid leave after 10 years of continuous service with one employer, under the Long Service Leave Act 1955. After that you accrue a further month for each additional 5 years.

Do I get long service leave if I resign in NSW?

Between 5 and 10 years, only in limited cases: the employer ends your employment for any reason except serious and wilful misconduct, or you resign because of illness, incapacity, or a domestic or other pressing necessity. A plain resignation before 10 years pays nothing, so the timing of a job change can be worth thousands.

Is long service leave paid at my normal rate in NSW?

It is paid at your ordinary gross weekly wage, excluding overtime and most allowances. If your pay has changed, the rate is generally the higher of your current rate or your average over the last 5 years.
